Both companies we represent offer FLSA in some form or fashion. Aspen including defense and indemnity Beazley on a defense only basis. The rules for determining wheher an employee is exempt from minimum wage or overtime can e confusing and there is a moral hazrd that must be considered. Except for risks that have very few employees or have been covered for this peril in the previous policy we will require a supplemental application. One of the questoions we ask is with whom did the insured consult in making the status determination and does that consultant - Lawyer, HR consultant, Accountant, Bartender -have E&O coverage. We urge all of our client to consult with someone competent and we willbe happy to make a referral upon Request.
